Mediation Services
Mediation is an amicable way for people to work through conflicts with the guidance of a neutral third party, known as a mediator. Unlike court proceedings, mediation is entirely voluntary and confidential, creating a safe space where each person’s perspective is valued. This approach allows the parties to find common ground, often leading to a faster, more cost-effective, and less confrontational solution.
Divorce Settlement Agreements
A divorce settlement agreement is a carefully crafted document that provides a roadmap for two people who are navigating the difficult journey of separation. It outlines, with clarity and respect, how property will be divided, debts handled, and arrangements made for child care and contact.
Parenting Plans
A parenting plan is an agreement between separated or divorced parents to work together in raising their child. It outlines shared responsibilities like caregiving, decision-making, and financial support, offering stability and reassurance. This plan ensures children feel secure, loved, and supported as family dynamics change.
Maintenance Orders
A maintenance order for children is a legal commitment that ensures a child's well-being is prioritized, even when parents are no longer together. It requires that the parents provide financial support to cover the child’s living expenses, education, and other essential needs, helping to create stability and security.
Arrears Maintenance
The mediator helps calculate the total amount owed in arrears, based on the agreed-upon maintenance amount and any missed payments over time. Conversations are guided about ways to address unpaid support, exploring flexible repayment options that consider the needs and limitations of both parents. Together, they work toward a plan that feels fair and manageable for everyone involved.
Section 22 Agreements
A Section 22 agreement in South Africa allows parents to address care, contact, and financial support for their children without going to court. Under the Children's Act, it enables thoughtful, child-centered decisions, including involving third parties such as extended family who aren’t biologically related.
Child Participation (Voice of the Child)
In mediation, listening to the child’s voice means gently considering their thoughts and feelings related to their care.
